Regulation of Cyberspace
Objective of the Paper: To create an understanding in the students regarding regulation of cyber space. The paper also makes students understand ways to resolve cyber disputes. The last part deals with Cyberspace regulation internationally.
Learning outcomes: On completion of this paper/course student should be able to-
- To equip the students with the overall regulation in cyber law including the laws which are applicable, process of filing a complaint and process of resolution .
- To develop the skills among the students to enable them to detect Cyber crime by using cyber forensic
- To make the students aware international treaties, conventions and protocols which have been signed concerning cyberspace.
Issues of Jurisdiction and Appicable Law in Cyberspace : Theories of jurisdiction in criminal cases, general jurisdiction in computer crimes, application of ‘effect’ doctrine in computer crimes, convention on cyber crime.
Enforcement issues in cyberspace : Prevention of cyber crime :deterrence as a means of prevention, technology as aid to prevention, user awareness, IT Act & prevention of offences.
Detection of Cyber crime, user of cyber forensic: Ongoing efforts in India to sustain cyber crimes.
Online Dispute Resolution : Meaning, functioning of ODR, kinds of disputed handeled in ODR, Types of ODRS Communication Modes in ODR.
International Treaties, Conventions and Protocols Concerning Cyberspace : UN Commission on International trade Law, Council of Europe, WIPO, WTO, Council of Europe..
